Welcome to Gaia's Garden Organics. These Terms of Service ("Terms") govern your use of gaiasgardenorganics.com ("the site") and any purchase you make from us. By using the site or placing an order, you agree to these Terms. If you don't agree, please don't use the site.

Who we are

Gaia's Garden Organics is a small, family-run herbal apothecary based in Umpire, Arkansas, founded by clinical herbalist Gaia Devi Stillwagon. In these Terms, "we," "us," and "our" refer to Gaia's Garden Organics; "you" and "your" refer to the person using the site or placing an order.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order or create an account. By using the site, you represent that you meet this requirement and that all information you provide is accurate and complete.

Herbal product disclaimer

Our products are not intended to diagnose, treat, cure, or prevent any disease. Statements on this site have not been evaluated by the Food and Drug Administration. Our teas, tinctures, flower essences, and skincare are traditional herbal preparations, offered for general wellness and supportive use.

Herbal products can interact with medications and may not be appropriate for every person. If you are pregnant, nursing, taking prescription medications, managing a medical condition, or preparing for surgery, please consult a qualified healthcare practitioner before using any of our products. Content on this site — including blog posts, quizzes, and guides — is for educational purposes and is not medical advice. We encourage you to work with your own healthcare provider for personal medical decisions.

Some products are offered for use with companion animals. Veterinary guidance is recommended for any pet experiencing ongoing symptoms.

Orders, pricing, and availability

All orders are subject to acceptance and availability. We may refuse or cancel an order at our discretion — for example, in the case of a pricing error, suspected fraud, inventory shortage, or shipping restriction.
Prices are shown in U.S. dollars. Applicable sales tax is calculated at checkout based on your shipping address.
We use our best efforts to display accurate product information, but occasional errors in pricing, descriptions, or availability can occur. If we discover an error after you've placed an order, we'll let you know and give you the chance to confirm or cancel.
Photographs are illustrative. Because our products are small-batch and plant-based, color, fragrance, and appearance may vary slightly from bottle to bottle.

Payment

We accept the payment methods offered at checkout, which are processed by Stripe. By submitting payment information, you authorize us (through Stripe) to charge the payment method for the total order amount, including any applicable taxes and shipping. We do not see or store your full card number.

Shipping

We ship from Umpire, Arkansas via USPS. Shipping rates are calculated at checkout based on the weight of your order. Current processing times, carriers, tracking information, and any shipping-related limits are outlined on our Shipping Policy page.

Title and risk of loss pass to you when we hand the package to the carrier. If your order is damaged, lost, or stolen in transit, please contact us as soon as possible and we'll do our best to help resolve it.

Returns and refunds

Because our products are handmade, consumable herbal preparations, returns are handled on a case-by-case basis. Our full policy — including how to reach us about a damaged or defective order — is on our Refund Policy page.

Subscribe & Save subscriptions

Selected products are available on a recurring subscription with a 15% discount. By starting a subscription, you authorize us (through Stripe) to automatically charge your payment method at the cadence you chose (every 1, 2, or 3 months) until you cancel or change the subscription.

You can pause, change the interval, update your payment method, or cancel your subscription at any time through the Stripe Customer Portal, which we link from your order confirmation and account emails.
Cancellation takes effect before the next billing date. We don't prorate or refund a shipment that has already been processed.
Prices and product availability for subscriptions can change. We'll let you know in advance by email if we need to update the price of an active subscription.

Promotional codes and offers

Promotional codes — including welcome offers — are limited to one use per customer unless we state otherwise, cannot be combined with other discounts, have no cash value, and can be revoked or modified at any time. Codes must be entered at checkout; we can't apply them retroactively.

Accounts and login

Some areas of the site — such as subscription management — use a secure link we email to you. If an account is created on your behalf, you are responsible for keeping your login credentials confidential and for all activity that takes place under them. Let us know right away if you suspect unauthorized access.

User-submitted content

When you submit a product review, testimonial, photo, or message through the site, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and adapt that content in connection with our business — including on the product page, in marketing emails, and on social media. You represent that the content is yours to share and that it does not violate anyone else's rights. We reserve the right to moderate, edit, or remove submissions for any reason.

Intellectual property

All site content — including text, graphics, photography, product formulations, recipes, logos, and the "Gaia's Garden Organics" name and brand — is owned by us or licensed to us and is protected by copyright, trademark, and other intellectual property laws. You may view and share our content for personal, non-commercial use. You may not copy, republish, reproduce, or use it commercially without our written permission.

Acceptable use

When using the site, you agree not to:

Interfere with the site's security, performance, or availability.
Attempt to access any area of the site you're not authorized to use.
Use the site to send spam, harass others, or violate any law.
Scrape or harvest content or customer information.
Misrepresent yourself or impersonate another person.

Third-party links and services

The site may include links to third-party websites or services (for example, Stripe's Customer Portal). We're not responsible for the content, policies, or practices of any third-party site. Your interactions with those services are governed by their own terms.

Disclaimers

The site and our products are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any herbal product will produce a specific result.

Limitation of liability

To the maximum extent permitted by law, Gaia's Garden Organics and its owners, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the site or products — including lost profits, lost data, or personal injury — even if we were advised of the possibility of such damages. Our total liability for any claim related to the site or a product will not exceed the greater of (a) the amount you paid for the product at issue, or (b) $100.

Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Gaia's Garden Organics and its owners, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of a product, or your violation of applicable law.

Governing law and dispute resolution

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law principles. Before filing a claim, you agree to first contact us at hello@gaiasgardenorganics.com so we can try to resolve it informally. Any dispute that can't be resolved informally will be brought exclusively in the state or federal courts located in Arkansas, and you consent to the personal jurisdiction of those courts.

Changes to these Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Material changes will be highlighted here or communicated by email. Your continued use of the site after an update constitutes acceptance of the revised Terms.
